WHAT IS THE DEFINITION OF PERSONS WITH DISABILITIES?

Disability occurring from an impairment implies any constraints or inadequacy of capacity to perform an action in the means or within the range assumed normal for a human being’.

As per the estimation of the Census of 2011 out of the entire population of 121 crores approximately 2.68 crores individuals are ‘Disabled’ and are 2.21% of the cumulative population, in India.

There are 1 billion people with disabilities, which is 15% of the global population, globally.

The United Nations has announced December 6 as the International Day of Persons with Disabilities. The day envisages the advancement of the rights, freedoms, and welfare of persons with disabilities in all facets of political, social, economic, and cultural spirit.

GLIMPSE ON WORLD RECORD AT SIACHEN GLACIER ‘OPERATION BLUE FREEDOM’

A crew of people with disabilities from across the country has undertaken an expedition to Kumar Post (Siachen Glacier) at an altitude of 15,632 feet to create an exotic World Record.

They are trained by Team ‘CLAW’ (Conquer Land Air Water) is a team of a group of ex-Indian Special Forces Commandos working towards empowering people with Disabilities. CLAW was established by Major Vivek Jacob in January 2019, a retired Para Special Forces Officer.

UNCRPD envisages the rights of Persons with Disabilities across the world.

QUICK LOOK ON THE UNCRPD

Persons with Disabilities face discrimination and the Denial of Human Rights, the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) addresses this problem.

In December 2006 the Convention on the Rights of Persons with Disabilities was recognized by the United Nations General Assembly and it came into force in May 2008.

India ratified the convention on October 1, 2007. It is an international human rights treaty that reaffirms that all persons with all classes of disabilities must celebrate all human rights. It also acknowledges Sign languages.

SIGN LANGUAGES

Developing countries comprise more than 80%, according to the World Federation of the Deaf lives, deaf and there are more than 70 million deaf people globally.

The United Nations Convention moreover recognizes and promotes the aim of Sign Languages. Sign languages have evolved as effective centers of communication, and they shape the nucleus of local Deaf cultures. It is an extraordinary chance to help and safeguard the linguistic and cultural diversity of all deaf people and distinct sign languages users.

Recently, on September third the international day on Sign Languages 2021 has been commemorated to increase awareness about the significance of sign languages. This year’s theme of sign languages is “We Sign for Human Rights”.
The Day was first applauded in 2018 as part of the International Week of the Deaf.

The legislation of Rights of Persons with Disability has been amended to fulfill the obligation of the United Nations Convention on the Rights of Persons with Disability in 2016.

INDIA’S LAW ON THE RIGHTS OF PERSONS WITH DISABILITY

The Rights of Persons with Disability Act (RPDA), 2016, as per the law there are 21 types of Disabilities (increased from 7 to 21). Below are the 21 types of Disabilities that everyone must know.

  4. Deaf and Hard of Hearing, Hearing Impairment
  5. Locomotor Disability
  6. Dwarfism
  7. Intellectual Disability
  8. Mental Illness
  9. Autism Spectrum Disorder
  10. Cerebral Palsy
  11. Muscular Dystrophy
  12. Chronic Neurological Conditions
  13. Specific Learning Disabilities
  14. Multiple Sclerosis
  15. Speech and Language DISABILITY
  16. Thalassemia
  17. Hemophilia
  18. Sickle Cell disease
  19. Multiple DISABILITIES including deaf-blindness
  20. Acid Attack victims
  21. Parkinson’s disease

Under this act people suffering from Disabilities retain the reservation for jobs from 3% to 4% in government jobs and from 3% to 5% in higher education institutes.

Each child shall have a right to free education with baseline disability (40% of any above-mentioned disability) between the age group of 6 and 18 years.

Under the Ministry of Social Justice and Empowered, the Department of Empowerment of Persons with DISABILITIES encourages and promotes the empowerment of the persons with Disabilities ‘Divyangjan’.

ARTICLE 41 AND 21 ON DIVYANGJAN

Article 41 of the Directive Principles of State Policy (DPSP) states that the state shall make important provisions for ensuring

Right to public employment in cases of unemployment, sickness, and disablement, within the thresholds of its economic capability and development.

Right to Education

Under Article 21 of the constitution, all persons including the disabled have their life and liberty guaranteed by the Constitution.

The subject of ‘relief’ of the disabled and ‘unemployable’ is specified in the Seventh Schedule of the Constitution under the State list.

Several Schemes have been implemented by the government of India to empower and support persons with disabilities here we will be discussing some of the schemes among them.

SCHEMES ON PERSONS WITH DISABILITY

  1. E-VIDYA PROGRAMME

E-Vidya Programme aims at fulfilling the goal of Inclusive Education was launched on May 17, 2020. The program aims at the advancement of special e-content for the Divyang (Children with Disabilities-CDs). E-Content includes text, tables, diagrams, visuals, audio, videos, etc.

2. DISHA SCHEME

Disha scheme aims at setting up Disha centers for early intervention and school readiness. 0-10 years of age group Children’s are permitted. Provision of Therapies, training and assisting family members have been included. Day-care facilities to Persons with Disabilities for at least 4 hours a day.
Batch size 20 Persons with Disabilities.

3.COMMUNITY BASED INCLUSIVE DEVELOPMENT PROGRAMME ON REHABILITATION OF DIVYANJAN

The program has been initiated by the Ministry of Social Justice and Empowerment. The program is based on the Rehabilitation of Divyangjan. The program has been launched for six months.
